The Appeal Court sitting in Markudi has nullified the election of the former Senate President, David Mark and ordered the Independent National Electoral Commission, INEC, to carry out a re-run of the election within 90 days.
The All Progressives Congress, APC, senatorial candidate for Benue South, Donald Onjeh had challenged the decision of the National and State Assembly Election Petitions Tribunal, which upheld Mark’s victory.
Onjeh’s lawyer, Adetunji Oso, also requested that the Appeal Court allow his appeal while setting aside the decision of the Tribunal.
This is coming after Onjeh appealed against the Tribunal Judgment upholding the election
.
He said the court erred when it held that the papers tendered by his client were mere documentary hearsay.
The National and State assembly elections petition Tribunal sitting in Makurdi, had on October 6, 2015 upheld the election of David Mark as Senator which held on March 28, 2015 but Onjeh appealed the judgment.
Mark is currently the longest Serving senator in Nigeria. He was elected in 1999, 2003, 2007, 2011 and 2015.
He served as President of the Senate for an uninterrupted 8 years.
